This course covers the history of the debt buying industry, the life cycle of a debt, industry regulations, collection issues and responsibilities including state licensing and consumer communications. The course is designed as a general overview of the industry in order to establish a base for best practices. The Introductory Survey Course on Debt Buying is required for individuals seeking to become a Certified Receivables Compliance Professional (CRCP) through DBA International.

We examine attorney professional ethics issues unique to attorneys engaged in debt collection. Topics explore the tensions between the Fair Debt Collection Practices Act and the Model Rules of Professional Conduct, including a look at the recent decision in the Bock v. Pressler & Pressler and the Consumer Financial Protection Bureau’s efforts to regulate attorney conduct. Don and Manny will also discuss the ethical implications raised by the 7th Circuit Court of Appeal’s decision in McMahon which may require giving legal advice to unrepresented persons and the latest developments in supervision of non-attorneys, use of technology in a collection practice and “meaningful involvement.”

During this session attendees will be guided by CFPB industry experts through the process of developing a comprehensive set of compliance management system policies and procedures and the controls required to ensure compliance with each. Special emphasis will be placed on identifying weaknesses in your policy and procedure inventory, the legal decisions you must make and the risks you must consider before implementing a policy and the attributes of a CFPB ready policy and procedure program. Each participant will leave the session with a check list of required policies and procedures.

 Navigating the Future of Medical Debt Buying

Medical debt continues to rise. According to the American Hospital Association, U.S. hospitals provided $45.9 billion in uncompensated care in 2012, representing 6.1 percent of annual hospital expenses. In order to be profitable, debt buyers must accurately bid on a portfolio. Once it's obtained, they must prioritize collection efforts in order to find those most likely to pay. Attend this session to hear how debt buyers and collection agencies can run healthcare industry specific statistical models against outstanding balances, to quickly identify which patients are likely to pay and the value of that payment. Debt buyers can use this information to optimize bids and then use the information in collection strategies in order to keep costs down and increase liquidations. Attendees will also gain insight into HIPAA and the Pinto’s Ruling, and how best to prioritize or segment patients into different collection treatment plans.

The Consumer Financial Protection Bureau is considering new restrictions on debt-collection practices and debt-buying. Yet to improve the functioning of the debt-collection system and promote consumer welfare overall, the CFPB must try to ensure that the benefits of its new regulations exceed the costs. Professor Todd Zywicki, author of Consumer Credit and the American Economy (Oxford 2014) and Former Director of the Office of Policy Planning at the Federal Trade Commission, will discuss the history and economic analysis of the regulation of debt collection and will provide you with the arguments and talking points when talking to policy-makers at the state and federal level about debt collection regulation.

We will utilize data gathered publishing TDCD to provide conference attendees a menu of possible topics we will address at DBA's 18th Annual International Conference. We will circulate an email survey to all DBA members approximately two weeks before the conference with six proposed topics (gleaned from the most popular recent TDCD topics) and also allow members to suggest other topics. This format will allow input from members and will guarantee that the most timely, popular topics will also be discussed. The membership would vote to select three topics of greatest interest that we would address and also suggest other topics. This format worked extremely well in 2014 and we had significant and constructive feedback from the attendee survey before the conference which shaped that presentation. This session will provide information on the most current issues facing the debt buying industry and will give the attendees specific directions on how to comply with the law without decreasing collections.

This course would provide a narrative of what the expectations would be to meet the requirements of 12 CFR 205, also known as Regulation E (Electronic Funds Transfers). In particular, the discussion will include the requirements from Reg E for consumers to electronically authorize the use of recurring electronic transactions. Several current solutions will be provided and reviewed. Attendees will understand what type of transactions Reg E effects; will know what is required to legally obtain an electronic approval for recurring payment transactions by the consumer and will be given several of the current solutions that are available on the market to meet the Reg E requirements.
