 Introductory Survey Course on Debt Buying
Speakers: Rozanne Andersen (Ontario Systems, LLC), Dennis Hammond (The Debt Marketplace, Inc.), Mark Naiman (Absolute Resolutions Corp) & Tomio Narita (Simmonds & Narita LLP)
Certification: 4 credits

This course covers the history of the debt buying industry, the life cycle of a debt, industry regulations, collection issues and responsibilities including state licensing and consumer communications. The course is designed as a general overview of the industry in order to establish a base for best practices. The Introductory Survey Course on Debt Buying is required for individuals seeking to become a Certified Receivables Compliance Professional (CRCP) through DBA International.

 Ethics and Consumer Financial Services Law
Speakers: Don Maurice (Maurice & Needleman) & Manny Newburger (Barron & Newburger, P.C.)
Certification: 2 credits

We examine attorney professional ethics issues unique to attorneys engaged in debt collection. Topics explore the tensions between the Fair Debt Collection Practices Act and the Model Rules of Professional Conduct, including a look at the recent decision in the Bock v. Pressler & Pressler and the Consumer Financial Protection Bureau’s efforts to regulate attorney conduct. Don and Manny will also discuss the ethical implications raised by the 7th Circuit Court of Appeal’s decision in McMahon which may require giving legal advice to unrepresented persons and the latest developments in supervision of non-attorneys, use of technology in a collection practice and “meaningful involvement.”

In this session, we will take a in depth look at each of the Series A standards. We will discuss real world examples of how compliance with each standard can be achieved and provide the guidance needed to kick start your path to Certification! Representatives from two certified debt buyers and one audit firm will walk you through the process beginning to end in this interactive session.

 Consumer Collection in the Year of 2020

This presentation will review the history of legal collection of consumer debts as a background to explore what the future will hold for collection of consumer debts in the year 2020. The focus of the program will be on the ever increasing role of regulation in collection of debts, whether by direct creditors or debt buyers. The program will explore how anticipated advanced in technology will promote more effective, reliable and profitable legal collections while at the same time enhance client audit requirements and foster regulatory compliance.

Attendees should expect to leave this session with their own Risk Assessment to take back to their company. Through audience participation and qualified guidance, attendees will receive the tools and knowledge to begin their tailored Risk Assessment during this interactive experience. Many DBA members believe that they're not able to do their own assessment or that you have to hire a third-party to do it for you. This hands-on process will demonstrate how to start and complete the Risk Assessment that's needed to satisfy the requirements for compliance frameworks such as PCI, SOC 2, FISMA, DBA Certification, etc.

The Key Attributes of Policies and Procedures for the Debt Buying Industry
Debt buyers large and small are at various stages of CFPB Readiness and by all accounts need practical, real time, real world advice. During this session attendees will be guided by CFPB industry experts through the process of developing a comprehensive set of compliance management system policies and procedures and the controls required to ensure compliance with each. Special emphasis will be placed on identifying weaknesses in your policy and procedure inventory, the legal decisions you must make and the risks you must consider before implementing a policy and the attributes of a CFPB ready policy and procedure program. Each participant will leave the session with a check list of required policies and procedures.
